Breach of Warranty of Habitability

Your landlord may be in breach of the warranty of habitability if you are experiencing lack of: electricity, hot running water, heat, operable windows or doors, sanitary and safe common area, refrigerator, and other necessities. 


Additionally, if you are noticing the presence of rodents, experiencing plumbing issues, leaking roofs, or having plumbing issues, your landlord may be in breach of warranty of habitability.

 

As stated by law, landlords must provide these necessities to all rental units. Failure to provide these necessities may result in the tenant withholding rent, however, consult with an attorney prior to doing so because withholding rent may put your tenancy at risk.


Your unit may be uninhabitable under California law if one or more of the following conditions exists: 


Breach of Warranty of Habitability Checklist: 


Rodent/insect infestation

No Heat

Defective Plumbing

Inadequate/defective wiring

Common areas unclean

No locks

Water leaks intrusion

Dangerous/dirty/ floors

No mailbox

Holes in Wall

Cracks in Wall

Gaps around doors

No working windows

Mold/Mildew

No refrigerator

Notice of Violation has been issued
